These terms apply to your use of this website and to coaching services provided by Rohini Bhattacharya ("the Coach"). By using the site or purchasing coaching, you agree to them.
Coaching services
Coaching is delivered online and may include training programs, nutrition guidance, check-ins and messaging, as described in the package you select. The specific inclusions of your package are confirmed when you enroll.
Eligibility
You must be at least 18 years old and able to enter a binding agreement.
Not medical advice
The Coach is not a physician, registered dietitian or licensed healthcare provider, and coaching is not medical care. Information on this site and in coaching is for general education and fitness purposes only. Consult your physician before beginning any exercise or nutrition program, and stop exercising and seek medical help if you feel pain, dizziness or discomfort.
Nutrition guidance
Nutrition guidance is general and educational. The Coach does not diagnose, treat or prescribe diets for any medical condition and does not replace a registered dietitian. [Lawyer to confirm the rules on individual nutrition advice where the Coach and clients live.]
Health conditions
Tell the Coach before you start if you are pregnant or postpartum, have or have had an eating disorder, or have a heart condition, diabetes or any other medical condition. The Coach may ask for written clearance from your doctor and may decline or end coaching where it would not be safe.
Assumption of risk
Physical exercise carries an inherent risk of injury. You participate voluntarily, are responsible for exercising within your limits, and accept those risks. To the extent the law allows, you release the Coach from claims arising from your participation, except where caused by the Coach's gross negligence or willful misconduct.
Your responsibilities
You agree to provide accurate information about your health and history, to tell the Coach about any changes, and to follow exercise instructions with proper care.
Fees and billing
Package prices are shown on the Packages page in US dollars. If your package renews monthly, you are shown the price and renewal terms before you pay and asked to agree to them, and you can cancel by email at any time as the Refund Policy explains. Results
Results vary and depend on many factors outside the Coach's control. No specific result is guaranteed.
Intellectual property
Programs, videos, guides and other materials are provided under a personal, non-transferable license for your own use only. They may not be shared, resold or published, and calls or videos may not be recorded or posted without permission.
Ending coaching
The Coach may end coaching for non-payment, abusive behavior, unsafe conduct, or withholding health information that affects your safety. Any refund in that case follows the Refund Policy.
Testimonials and photos
Your name, photos, results or words are never published without your separate written permission, which you can withdraw for future use at any time.
Availability
Coaching is not an emergency service. Response times are typical, not guaranteed, and may change during holidays or illness.
Limitation of liability
To the fullest extent allowed by law, the Coach is not liable for indirect or consequential damages, and total liability for any claim is limited to the fees you paid in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of [State], without regard to its conflict-of-laws rules. Before starting a formal claim, both sides agree to try to resolve the dispute informally by email for 30 days.
